We Can File New DACA Right Now!

The U.S. Department of Homeland Security said it would administer the Deferred Action for Childhood Arrivals (DACA) program under the guidelines crafted by the Obama administration in 2012. Starting Monday, DHS said it would grant approved applicants work permits and deportation deferrals that last for two years and allow DACA-holders to request permission to travel abroad under certain circumstances.

USCIS posted this morning their acceptance of first-time DACA applications. This is great news!

Starting Monday, DHS said it would grant approved applicants work permits and deportation deferrals that last for two years and allow DACA-holders to request permission to travel abroad under certain circumstances.

There is no guarantee the program will remain in place so anyone who believes they are eligible should start their application right now. DACA will also now be for 2 years instead of one year. You may request DACA if you:

  1. Were under the age of 31 as of June 15, 2012;

  2. Came to the United States before reaching your 16th birthday;

  3. Have continuously resided in the United States since June 15, 2007, up to the present time;

  4. Were physically present in the United States on June 15, 2012, and at the time of making your request for consideration of deferred action with USCIS;

  5. Had no lawful status on June 15, 2012.
