What is a K-1 Visa?

The K 1 Fiancé Visa is an immigration route tailored for U.S. Citizens looking to marry an individual from another country and bring them to the United States for marriage purposes.

Understanding The Goal of The K-1 Visa

The objective of granting a K-1 Visa is to allow couples to be together in the U.S. enabling them to legally marry. It acts as a precursor towards obtaining residency (commonly referred to as a Green Card) for their foreign fiancé(e).

Who Qualifies?

Before starting your application process for a K-1 Visa it's vital that both you (the U.S. Citizen petitioner) and your fiancé(e) (the beneficiary) meet requirements. These conditions typically include:

1. The petitioner must be a U.S. Citizen.

2. Both individuals must meet the requirements, for marriage.

In applying for a K 1 Visa the couple must genuinely plan to marry within 90 days of the arrival of the foreign fiancé(e) in the United States.

The process involves steps:

1. Filing a Petition (Form I 129F): The U.S. Citizen petitioner must submit Form I 129F, also known as Petition for Alien Fiancé(e) to the U.S. Citizenship and Immigration Services (USCIS).

2. Consular Processing: Once USCIS approves the petition it is sent to the U.S. Embassy. Consulate in the foreign fiancé(e)s home country for processing.

3. Medical Examination: The foreign fiancé(e) will undergo an examination, as part of the process.

4. Interview: Both the U.S. Citizen petitioner and the foreign fiancé(e) will be interviewed at the U.S. Embassy or consulate.

5. Visa Issuance: If approved a K 1 Visa will be issued, allowing the foreign fiancé(e) to enter the United States.

6.. Adjustment of Status: After entering the United States both partners must marry within 90 days. Then apply for Adjustment of Status so that the foreign fiancé(e) can become a resident.

Going through each stage of applying for a K 1 Visa can be quite complex and demanding given factors, like the need for documents to prove the relationship between partners and understanding all the responsibilities involved.
